Introduction
The Giathat.vn e-commerce platform is provided through its website interface and other forms of access established, managed and operated by Gia That Company Limited (“Giathat.vn” or the “Platform”)
Gia That Company Limited, as the entity establishing, managing and operating Giathat.vn, shall hereinafter be referred to as “Gia That”, the “Company”, “we”, “us”, “our” or the “Platform Operator”
Before accessing or using Giathat.vn or registering an account on the Platform (an “Account”), please carefully read the Policy on the Rights and Obligations of Participating Parties, as well as other policies and regulations published on the Platform, in order to understand your rights and obligations when using the services.
By accessing the Platform, creating an Account or using any services available on Giathat.vn, you acknowledge that you have read, understood and agreed to comply with these Terms of Use, together with any regulations, policies and other terms and conditions published or incorporated by reference by Giathat.vn from time to time.
If you do not agree with any provision of these Terms of Use or any applicable regulations on Giathat.vn, please do not create an Account, access the Platform or use any services available on the Platform.
Users of Giathat.vn are responsible for ensuring that they possess full legal capacity and capacity for civil acts as required by applicable laws in order to register an Account and enter into and perform transactions on the Platform.
Where a user is a minor or has limited capacity for civil acts under applicable laws, the registration of an Account and the use of services on Giathat.vn may only be carried out with the consent, assistance or representation of such user's parent, guardian or other lawful representative, as required by applicable laws. The parent, guardian or lawful representative shall be responsible for ensuring that the person under their representation or guardianship understands and complies with the applicable terms and conditions when using Giathat.vn and shall assume the responsibilities prescribed by applicable laws in connection with such person's use of the Account and services, regardless of whether the Account has already been created or will be created in the future.
Rights and Obligations of the Platform Operator
Ensure that the operation of the Platform complies with the laws of Vietnam.
Establish, publish and implement the operating conditions, transaction terms and other regulations applicable to the use of Giathat.vn.
Develop and publish service standards, as well as procedures for user registration, participation and activities on the Platform.
Charge fees for services provided in accordance with the published pricing policies and payment terms.
Establish, maintain and implement necessary measures to ensure that Giathat.vn operates safely, stably and continuously.
Establish and implement appropriate management measures, including restricting, suspending or terminating the right to use an Account where a user violates applicable laws or regulations applicable on the Platform.
Remove any content that is unlawful, harmful, threatening, abusive, harassing, distressing, defamatory, misleading, obscene, insulting, offensive, invasive of another person's privacy, racially or ethnically discriminatory, or otherwise inappropriate.
Implement necessary measures to ensure information security and protect consumers' personal information in accordance with applicable laws.
Receive, support and handle users' requests, feedback and complaints within the scope of the Platform Operator's responsibilities.
Implement measures to monitor, detect and prevent violations of law on the Platform, and cooperate with and provide information and data to competent state authorities in accordance with applicable laws.
Rights and Obligations of Sellers on Giathat.vn
Have the right to register for, maintain, suspend or terminate activities relating to the posting of listings and the provision of goods and services on Giathat.vn in accordance with the regulations applicable on the Platform.
Have the right to use the technical infrastructure, features and supporting tools provided by Giathat.vn; access information and data relating to their activities on the Platform; and submit requests, feedback and complaints for receipt and handling in accordance with applicable regulations.
Provide complete and accurate information relating to their goods, services and business activities, and promptly update such information when necessary; and be responsible for the content posted by them on the Platform.
Ensure the quality and legality of goods and services and compliance with applicable conditions for their circulation or provision; and fully perform obligations owed to Buyers, including obligations relating to delivery, warranties, returns and refunds, in accordance with the agreement between the parties and applicable laws.
Be responsible for communicating and reaching agreement with Buyers regarding the method, time, location, costs and other conditions relating to delivery, and carry out the delivery in accordance with the terms agreed between the parties.
Not use or exploit Giathat.vn to conduct prohibited investment or business activities; trade in goods or services prohibited by law; deal in counterfeit goods or goods infringing intellectual property rights; or carry out any other unlawful activities.
Fully perform financial obligations to the State in accordance with applicable laws and implement necessary measures to protect Buyers' data and consumers' information.
Cooperate with the Platform Operator and competent state authorities in verifying information, resolving complaints, handling violations and performing other obligations as required by applicable laws.
Not upload, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, distressing, misleading, defamatory, obscene, insulting, offensive, invasive of another person's privacy, racially or ethnically discriminatory, or otherwise inappropriate.
Not use any method, tool, software or conduct that may adversely affect, interfere with, disrupt or cause damage to the operation, stability, safety or security of the Platform.
Not infringe upon the lawful rights and interests of Giathat.vn and/or the Platform Operator, including but not limited to intellectual property rights, or cause confusion regarding such rights.
Rights and Obligations of Buyers on the Giathat.vn Platform
Have their lawful rights and interests as consumers protected and be provided with and have access to complete and accurate information regarding goods, services and Sellers before deciding to enter into a transaction.
Have the right to select goods, services, payment methods and delivery methods appropriate to their needs and transaction conditions, and have their personal data and information protected in accordance with applicable laws.
Be responsible for proactively communicating and reaching agreement with Sellers regarding the method, time, location, costs and other conditions relating to the receipt of goods, and for cooperating and performing the necessary obligations to receive the goods in accordance with the terms agreed between the parties.
Have the right to submit requests, feedback and complaints relating to the use of the Platform or transactions and have such matters received and handled in accordance with applicable regulations and within the scope of the Platform Operator's responsibilities.
Be responsible for providing complete, accurate and timely information necessary for the performance of transactions and for making full and timely payment in accordance with the agreement with the Seller.
Be responsible for proactively communicating and reaching agreement with Sellers regarding the method, time, location, costs and other conditions relating to the delivery and receipt of goods, and for cooperating with Sellers during the delivery and receipt process in accordance with the terms agreed between the parties.
Comply with applicable laws, operating conditions, transaction terms and other regulations published on Giathat.vn, and not use or exploit the Platform to commit fraud, deception or any other unlawful acts.
Not upload, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, distressing, misleading, defamatory, obscene, insulting, offensive, invasive of another person's privacy, racially or ethnically discriminatory, or otherwise inappropriate.
